The ‘Pegasus’ program as a legal technical measure used in the course of operational surveillance – commentary on the judgment of the Court of Appeal in Wrocław of 11 May 2023, II AKa 480/21
Abstract
The author critically evaluates the position of the Court of Appeal in Wrocław expressed in the judgment of 11 May 2023 (II AKa 480/21), in which the Court deemed the use of technical measures resembling the Pegasus software in operational surveillance as illegal. The author argues
that police legislation (including the Act on the Central Anti-Corruption Bureau) does not impose any limitations regarding the types of technical measures used. He concurs with the position of the Constitutional Tribunal that the technical measures employed in operational surveillance must be
based on the latest technologies enabling the acquisition and recording of information.
