Streszczenie w języku polskim


W glosowanym wyroku Trybunał Sprawiedliwości Unii Europejskiej (TSUE) po raz kolejny zajął się kwestią równowagi między wzajemnym zaufaniem a prawami podstawowymi jednostek w sprawach azylowych, w szczególności przekazywania osób ubiegających się o azyl na mocy rozporządzenia Dublin III. Zasada wzajemnego zaufania opiera się na domniemaniu, że wszystkie państwa członkowskie są uważane za kraje bezpieczne dla obywateli państw trzecich. Domniemanie przestrzegania przez państwa członkowskie ich zobowiązań wynikających z prawa Unii Europejskiej jest wzruszalne, lecz ma to zastosowanie tylko wtedy, gdy „w procedurze azylowej i w warunkach przyjmowania wnioskodawców w tym państwie członkowskim występują wady systemowe, powodujące pojawienie się ryzyka nieludzkiego lub poniżającego traktowania w rozumieniu art. 4 Karty Praw Podstawowych Unii Europejskiej”. W wyroku TSUE kontynuuje i wzmacnia ustaloną linię orzeczniczą dotyczącą transferów na mocy rozporządzenia Dublin III. Trybunał podtrzymał zasadę wzajemnego zaufania między państwami członkowskimi Unii Europejskiej jako fundamentalną dla funkcjonowania systemu dublińskiego, jednocześnie identyfikując jeszcze jedną kategorię poważnych, potencjalnie systemowych wad w procedurze azylowej i w warunkach przyjmowania wnioskodawców. Chociaż TSUE podtrzymał tę zasadę, w komentowanym wyroku wprowadził wykładnię art. 3 ust. 2 rozporządzenia Dublin III, która wymaga, aby właściwe organy (sądy) przeprowadziły dokładniejszą weryfikację sytuacji prawnej i humanitarnej w innych państwach członkowskich. Znaczenie wyroku ujawnia się w jego wpływie na przyszłe orzecznictwo. Ponadto rzuca światło na ostatnie zmiany wprowadzone w polskim prawie azylowym.
