Micro-Green Spaces in Cities in Poland and the Flemish Region – an Overview of Legal Frameworks and Practical Functioning
Abstract
This article is based on an analysis of experiences in Poland and the Flemish Region of Belgium. It sheds light on the insufficiently recognized, yet crucial potential of micro-green spaces (such as community gardens, home green spaces, and green urban spaces) in counteracting the effects of the climate crisis and environmental degradation in cities. The aim of the article is to highlight the need to develop both legal regulations and practical application of law for small-scale nature conservation, which not only protects the environment but also activates residents and facilitates grassroots pro-ecological initiatives. The current legal framework in Poland and Flanders in the field of nature protection, spatial planning, construction law, and water management is analyzed, pointing out the existing systemic gaps, procedural limitations, and lack of clear regulations that favor the creation and protection of micro-nature. Special attention is paid to financial support mechanisms, the role of local governments, and the social dimension of green space management. The analysis shows that effective adaptation of cities to climate change and improvement of the quality of life of their inhabitants require not only strategic national policies, but also flexible, local legal and institutional tools that will enable the development and protection of green areas on the smallest, often private plots of land.
