Counteracting Artificially Created Conditions in the EU Common Agricultural Policy – the Scope of Action of the Paying Agency
Abstract
This article aimed to analyse the actions undertaken by the Agency for Restructuring and Modernisation of Agriculture to counteract the creation of artificially established conditions within the framework of support provided from the funds of the Common Agricultural Policy, as well as to assess the complexity and multidimensional nature of artificial conditions as one form of circumvention of the law. The following research questions were posed: How does the Agency for Restructuring and Modernisation of Agriculture identify and verify the occurrence of artificial conditions? What types of strategies are employed by beneficiaries to construct such artificial arrangements? In order to address these questions, an analysis was conducted of the current EU and national legal framework, as well as relevant case law of the Court of Justice of the European Union and Polish administrative courts.
