Rzymscy filii familias milites i specyfika ich odrębności o charakterze prawno-majątkowym w okresie Wczesnego Cesarstwa
Streszczenie w języku polskim
Rzymscy filii familias, jako osoby o statusie alieni iuris, podlegali władzy patriarchalnej (patria potestas) swoich własnowolnych zwierzchników familijnych (patres familiarum). Ci synowie obywateli rzymskich byli pozbawieni pełnej zdolności prawnej w zakresie rozporządzania majątkiem (bona domestica-peculium), którego byli jedynie użytkownikami, a do którego tytuł własności mieli rzymscy patres familiarum, tj. ich ojcowie lub dziadkowie. Jednak ta niekorzystna dla nich sytuacja zarówno w sferze prawnej, jak i majątkowej mogła ulec zmianie, kiedy było im dane wstąpić na służbę do armii rzymskiej.
Intencją autora niniejszego tekstu jest zrekonstruowanie statusu rzymskich żołnierzy (filii familias milites), którzy podlegli władzy zwierzchników familijnych i dla których fakt podjęcia służby w wojsku rzymskim stał się okazją, aby, z mocy prawa, nie tylko korzystać z ochrony, jeśli chodzi o przyznane im uprawnienie do dysponowania tzw. majątkiem „obozowym”, o odrębnym charakterze (tj. peculium castrense), ale, co ważne, otrzymać choć częściową niezależność pod wglądem samodzielnego nim rozporządzania (tj. testamentum militis).
